1.1 E-affiliate Club is an affiliate network, and it provides its partners access to the offers of its merchants subject to a revenue sharing program when the affiliate gets the commission from the sales of the users who got registered via affiliate links.
1.2 E-affiliate Club acts using its proprietary software via E-affiliateclub.com.
1.3 In order to participate in the network, the partner must complete the sign up process.
1.4. The Administration reserves the right to reject the affiliate’s sign up application without any obligation to disclose the reason.
2.1 Before the affiliate can proceed to work on driving users to the offers, they must register one or several traffic sources in the E-affiliate Club system.
2.2. Such traffic sources may be:
a. Websites owned by the partner;
b. Contextual advertising, banner and teaser ad networks;
c. Social networks;
d. Doorway pages created to drive traffic for low frequency search queries in search engines;
e. Media buying (traffic purchase and sale) platforms;
f. Other sources, subject the approval by the Administration.
2.3. The Administration checks each source within 72 hours before it is allowed for use.
2.4 The Administration reserves the right to reject any traffic source with no obligation to disclose the reason behind that.
3.1 The affiliate agrees that any advertising/marketing materials and campaigns that he uses to promote E-Affiliate Club offers in any format, including websites, content, email newsletters, must not:
- Violate any laws, legislative act, ordinances or regulations in any country or territory in which the affiliate operates or users of his website access the services;
- Advertise illegal activities;
- Contain or advertise obscene materials for minors (under 18 years of age) or pornography;
- Contain or promote materials that violate copyrights, patents, trademarks or other intellectual property rights;
- Promote violence;
- Promote discrimination based on race, gender, religion, nationality, disability, sexual orientation, age, etc.;
- Engage in advertising or marketing campaigns that are misleading and unlawful in any context;
- Engage in fraudulent or deceptive business practices or unfair competition;
- Participate in sending unsolicited email (“spam”), mass mailings in instant messengers;
- Include any E-Affiliate Club trademarks, their variations or typos, in the Partner’s domain names;
- Relate to files, programs, data streams or other materials that contain viruses or other destructive features that constitute an invasion of privacy or an unlawful invasion of privacy.
3.2 The affiliates can not:
a. Use unauthorized or forbidden sources, as well as official sources of the merchants (forums, blogs, public pages, etc.);
b. Drive up a numbers of actions in the system in any way, including:
i. Performing the necessary actions by themselves;
ii. Making users to perform the actions through of entreaty, remuneration, misleading, or deceit;
iii. Cloaking or changing referrers;
iv. Changing IP address within a single subnet or using proxy servers or anonymizers;
v. Using any sources forbidden for a specific offer as may be stated in the offer description;
vi. Using spam messaging to drive users or other affiliates;
vii. Using any graphic or other medium that is not relevant to the offer, including any materials referring to other products or brands;
viii. Using willful false information about the offer to drive in the users;
ix. Initiating any automated user actions by means of scripts, bots, and any other means;
x. Using toolbars or any other browser extensions to drive in the users.
d. Use any traffic from incentivized advertising sources (seosprint, wmmail, etc.), except when this traffic type is allowed by the offer settings;
e. Ignore information requests from the Administration concerning traffic sources or any other data concerning the partner’s activities within E-affiliateclub system;
f. Make any misrepresentations or mislead the Administration in any way;
g. Pass out any information concerning driving up numbers or fraud within the system.
4.1. The affiliate undertakes:
a. To follow these Terms and Conditions strictly;
b. To provide only true information as regards their activities within the E-affiliateclub network;
c. To turn to the E-affiliateclub Support Service in case they have any questions regarding their work with the network;
d. To give immediate response to the requests and addresses from the Administration, including removing the causes of the advertisers’ complaints in regards to ad medium content and quality, as well as sources and means of ad medium placement. If there is no response to any request of the Administration within 12 hours, the Administration has the right to apply sanctions against such non-responding partner.
e. To provide all data necessary for quality checks, including:
i. Links;
ii. Screenshots;
iii. Ad medium;
iv. Work schemes (general outline, with no details);
v. Online real-time screen sharing, etc. – at the request of the Administration.
f. The affiliates undertake not to create multiple accounts (more than one account) in the system except for written or e-mail permission from E-affiliateclub.com. In case the affiliate breaches these terms E-affiliateclub is entitled to block Partner permanently without any notification and withhold any payments to Affiliate.
4.2. The network Administration has the right:
a. To suspend payouts for the affiliate account for the purposes of checking the reliability of the data provided by the partner, or for the purposes of the partner’s traffic quality check (also at the request of merchant), as well as in case the Administration has a reasonable cause to believe that the partner may be in breach of these Terms and Conditions. At the time of the account payout suspension the Administration creates a ticket to the partner containing the reason and request for information.
b. To block any source that is in breach of these Terms and Conditions, including at the request from the merchant. At the time of the source blocking the Administration creates a ticket to the affiliate containing the reason and request for information.
c. To block, temporarily, until the circumstances are clarified, the traffic received from the affiliate at the merchant’s request.
d. To block, temporarily, until the circumstances are clarified, any partner referring other partners to the system, if 70% or more of the partners he/she drove to the system are banned in the system.
e. To block, temporarily, until the circumstances are clarified, any account if the partner does not respond to the Administation’s requests or does not work with the network for more than 3 months.
5.1. In case of any breach of these Terms and Conditions by the partner, the Administration of E-affiliateclub network has the right to:
a. Suspend all payouts for the account until the circumstances are clarified;
b. Ban the account with no possibility to enter the system, to request a payout, or to raise the ban;
6.1 Payment Methods – Payment shall be made to affiliate via Bank wire, Payoneer, Webmoney or via other payment methods, subject to Company’s sole discretion.
6.2 Each offer has a Hold period, which is equal to the number of days given to the network and merchant to check the action. After the Hold period expiry, if the action is not rejected by the network or merchant, the payout is available for withdrawal.
6.3 The partner’s account includes two fields: Balance and Available. The Balance shows potential earnings for actions that are under the Hold period. The Available field contains all funds available for withdrawal.
6.4. Payment procedure:
a. E-Affiliate Club pays the Partner a commission of 20-30% for each order made by the user using an affiliate link. An order means the user’s purchase of the site’s virtual currency, with which the client pays for virtual services - chats, letters, photos, videos, etc. - everything except gifts that are delivered physically.
Frequency of Payments:
All payments to partners are made monthly, for the previous month.
Affiliate profit is paid in full minus any service fees applicable to this transaction (for example, write-offs for SWIFT transfers or credit cards), which E-Affiliate Club pays or must pay to third parties (payment providers) for this transaction.
If a user referred to E-Affiliate Club by an Affiliate makes a chargeback or request for a chargeback from the Payment Provider, the commissions earned for these transactions will be rejected by E-Affiliate Club. If commissions have already been paid before a chargeback or refund of a purchase was requested, E-Affiliate Club may request a refund of the commissions for that sale from the Affiliate.
b. All payments are done at one time to all partners and it is not possible to make any individual payouts earlier than that.
c. To receive a payment the partner must request it through the personal account. Only the amounts in the Available field are available for such a request.
d. Each Affiliate’s account must reach a minimum €100 balance in order to be paid.
6.5. The partners may drive other partners (referred partners) to sign up with E-affiliateclub using their referral link from the personal account. The referring partner receives an amount equal up to 5% of his/her referred partner’s income.
6.6. All pending payments are expired after 365 days. In order to receive payment on time please send us an invoice with full payment information.
7.1 The Administration reserves the right to make changes to these Terms and Conditions at any time and without any prior notice.
7.2 This agreement and any disputes or claims arising out of or in connection with it shall be governed by and construed in accordance with the laws of the United Kingdom. Each party irrevocably agrees that the courts of the United Kingdom shall have exclusive jurisdiction to resolve any dispute or claim arising out of or in connection with this agreement.
